By accessing or using the services provided by Yekta Health Ltd (“Yekta”, “we”, “us”), including our website at yekta.health, mobile applications, and any associated services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our Services.

2. Description of Services

Yekta provides a health management platform that enables patients and healthcare professionals to track health data, access AI-driven insights, manage appointments, and communicate securely. Our Services are intended for informational and healthcare management purposes and do not constitute medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 16 years old to use our Services. Users between 16 and 18 must have the consent of a parent or guardian. By using the Services, you represent that you meet the applicable age requirement and have the legal capacity to enter into these Terms. Where the platform is provided through a healthcare organisation, your eligibility is also governed by that organisation’s enrolment process.

4. Account Registration

Certain features require account registration. You agree to provide accurate, complete information and to keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at hello@yekta.health if you suspect unauthorised access.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users’ data
  • Upload malicious code, viruses, or harmful content
  • Impersonate any person or entity
  • Use the Services to harass, harm, or threaten others
  • Reverse-engineer, decompile, or disassemble any part of the Services
  • Use automated tools to scrape or extract data from the Services

6. Health Information Disclaimer

The Services, including any AI-generated insights, are provided for informational and healthcare support purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information obtained through our Services.

In a medical emergency, call your local emergency services immediately (e.g. 999 in the UK, 112 in the EU, 911 in the US). Do not rely on this platform for emergency care.

7. Healthcare Provider Relationship

Where the Services are provided to you through a healthcare organisation or care provider (“Care Provider”):

  • Your Care Provider is responsible for determining your access to and use of the platform, for obtaining any necessary consents for your health data, and for the clinical appropriateness of any decisions made using the platform.
  • Your Care Provider acts as the Data Controller for your health data. Yekta Health Ltd acts as the Data Processor. For full details, see our Privacy Policy.
  • These Terms govern your use of the Yekta platform technology. Your Care Provider may have additional terms that apply to your care relationship.

8. Intellectual Property

All content, trademarks, logos, and intellectual property associated with the Services are owned by Yekta Health Ltd or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent. Your health data remains yours — we do not claim ownership over data you provide.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how your personal and health data is handled.

10. Third-Party Services

Our Services may integrate with or contain links to third-party services. We are not responsible for the content, policies, or practices of any third-party services. Your use of such services is subject to their own terms and privacy policies.

11. Limitation of Liability

To the maximum extent permitted by law, Yekta Health Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or health outcomes, arising from your use of the Services.

Our total liability for any claim arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms, at the request of your Care Provider, or for any other reason with reasonable notice. You may stop using the Services at any time. Upon termination, your right to use the Services ceases immediately, though provisions that by their nature should survive (including limitations of liability, intellectual property rights, and governing law) will remain in effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website and, for platform users, through the application or by email. Continued use of the Services after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
